Welcome to LockD In! Please read these Terms and Conditions ("Terms") carefully before using the LockD In mobile application and website (collectively, the "Services") operated by LockD In ("we", "us", or "our").
LockD In is operated by Younes El Bakkali, doing business as LockD In, a sole proprietorship with a mailing address at Gent, 9000, Belgium.
1. Acceptance of Terms
By accessing or using LockD In, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use our Services.
2. Description of Services
LockD In is a productivity, habit-building, and skill-learning application that helps users develop better habits and achieve their goals through features including, but not limited to:
- Interactive Skill Tree and progression system
- Self-directed research prompts for various topics (e.g., business, finance)
- App-provided tutorials and guides for specific skills (e.g., exercise, gardening)
- XP/leveling system and gamification
- Streak tracking and progress monitoring
- Daily habit tracking and task management
- Community forums and leaderboards
We reserve the right to modify, update, or discontinue any features of the Services at any time without prior notice.
3. Eligibility
You must be at least 18 years of age to use LockD In. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration and Security
To access certain features, you must create an account. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for all activities under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Content
You retain ownership of any content you create or share ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use it solely for operating and improving the Services. You represent that you own the rights to your content and that it complies with all laws. We reserve the right to remove objectionable content at our discretion.
6. Community Guidelines
When using community features, you agree to treat others with respect. You may not post offensive content, spam, share personal information without consent, or disrupt the Services. Violations may result in account termination.
7. Prohibited Uses
You agree not to use the Services unlawfully, attempt unauthorized access, reverse engineer the app, use automated scrapers, upload malware, or collect other users' data.
8. Subscriptions and Payments
8.1 Subscriptions
We may offer premium subscription plans. By purchasing, you authorize automatic renewals at the end of each billing period until you cancel. You may cancel at any time through your app store settings or our in-app settings, effective at the end of the current period. All purchases are final and non-refundable, except as required by law or Apple's App Store policies.
8.2 EU Consumer Right of Withdrawal Exception
If you are a consumer residing in the European Union, you normally have a statutory right to cancel your purchase within 14 days. However, by purchasing a digital subscription to LockD In, you expressly consent to receiving immediate access to the premium digital content and features. You acknowledge and agree that by accessing this digital content immediately, you waive and lose your statutory 14-day right of withdrawal and are not entitled to a refund.
9. Intellectual Property Rights
The Services and all original content, features, and functionality are owned by Younes El Bakkali and are protected by intellectual property laws. We grant you a limited, non-exclusive license for personal, non-commercial use. You may not copy, modify, or distribute our property.
10. Third-Party Services, Links, and Independent Research
The Services may contain links to third-party websites or provide prompts, topics, and suggestions for you to research independently (e.g., via the Skill Tree). We do not control or endorse these third-party services, nor do we provide the research materials. We are not responsible for the accuracy, completeness, safety, or legality of any information, tutorials, or third-party content you discover while conducting independent research. Your reliance on any externally sourced information is strictly at your own risk.
11. Monitoring and Enforcement
We reserve the right to monitor the Services, remove content, and take legal action against violators of these Terms.
12. Disclaimers and Limitations of Liability
12.1 "AS IS" and "AS AVAILABLE"
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
12.2 Skill Tree and Research Disclaimer
The topics, skills, and research prompts provided in the app are for informational and entertainment purposes only. We do not endorse or verify the safety of any specific skill. Participating in or practicing these skills may carry inherent risks. You acknowledge that you are solely responsible for assessing the safety and validity of the information you find or the skills you practice, and you assume all risks associated with them.
12.3 Financial and Earnings Disclaimer
The Services may include skill trees, nodes, or prompts related to business, finance, or money-making topics. These are provided for educational and entertainment purposes only. LockD In is not a registered investment advisor, broker, or financial planner. We do not provide financial, investment, or legal advice. Any independent research you conduct or financial decisions you make based on prompts from the app are strictly at your own risk. We make no guarantees regarding any potential income, profits, or financial success. You assume all risk of financial loss.
12.4 Health, Fitness, and Physical Activity Disclaimer
Certain features provide information or instructions related to physical exercise, gardening, DIY projects, or other physical activities. This content is for informational purposes only and is not a substitute for professional medical advice. Assumption of Risk: By participating in physical activities described in the app, you acknowledge they carry inherent risks of injury or property damage. You assume full responsibility for any risks or damages incurred. Always consult a healthcare provider before beginning any new physical regimen.
12.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR FULL LEGAL NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS OR $100 USD.
Exceptions for EU Consumers: Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our gross negligence, intentional misconduct, or any other liability that cannot be lawfully excluded or limited under applicable European Union or Belgian consumer protection laws.
13. Indemnification
You agree to indemnify, defend, and hold harmless Younes El Bakkali from any claims, liabilities, damages, or costs arising from:
- Your use of the Services
- Your User Content
- Your violation of these Terms or applicable laws
- Your practice, application, or misuse of any skills, physical activities, financial decisions, or research topics suggested by the Services.
(IN SIMPLE TERMS: If you do something wrong, or injure yourself/lose money practicing a skill, and we get sued because of it, you're responsible for the legal costs and damages — not us.)
14. Termination
You may terminate your account at any time. We reserve the right to suspend or terminate your account for violations of these Terms or other reasons at our discretion.
15. Dispute Resolution and Governing Law
15.1 Governing Law
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Furthermore, if you are a consumer residing in the European Union, you may also enjoy protection under the mandatory consumer protection laws of your country of residence.
15.2 Informal Resolution
If you have any dispute with LockD In, you agree to first contact us at support_@lockd-in.net to attempt to resolve the dispute informally. We will work in good faith to resolve any issues.
15.3 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the competent courts of Belgium.
15.4 European Online Dispute Resolution (ODR)
If you are a consumer residing in the European Union, you have the right to submit complaints to be resolved through an independent dispute resolution body. You can access the European Commission's Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/.
16. Rights and Terms for Apps
This Section applies to any App that you acquire from the Apple App Store or use on an iOS device. Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the App purchase price to you (if applicable) and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it. Apple and its subsidiaries are third-party beneficiaries of these Terms.
17. Changes to These Terms
We reserve the right to modify these Terms. Material changes will be notified via email or in-app notice and become effective 30 days after notification.
18. General Provisions
These Terms constitute the entire agreement. If any provision is unenforceable, the rest remains intact. We may assign these terms; you may not.
